Waiver/Agreement

In consideration of being permitted by Hillel House at the University of Massachusetts Amherst (the “Sponsor”) to participate in the Ride to Provide bike ride fundraiser on September 13, 2009 (the “Event”), I hereby, for myself, my heirs, and my personal representatives (collectively, “Participant”), assume any and all risks associated with the Event. As consideration for being permitted to participate in the Event, Participant to the fullest extent permitted by law, hereby waives, releases, discharges, and agrees not to sue the Sponsor, its officers, employees, sponsors, organizers, or volunteers; any municipalities involved with the Event and any agents, employees, or representatives of such municipalities; and the University of Massachusetts, and its employees, representatives, or agents in connection with any and all injuries or damages of any kind whatsoever suffered as a result of taking part in the Event and all activities related to the Event. Participant certifies that Participant is in proper physical condition and physically capable of participating in this Event without the risk of injury. Participant understands that the use of a helmet that complies with the guidelines established by the United States Consumer Product Safety Commission is mandatory and Participant is required to wear such a helmet at all times while on a bicycle or other manually-powered vehicle for the Event.

Participant consents, without compensation, to the use of film, photo, videotape, or digital images of Participant during the Event for any purpose, including, but not limited to, printed and digital use; and publication or republication in future Sponsor newsletters, advertisements, brochures, or other advertising or promotional materials.

If Participant is a parent or guardian of an individual under the age of 13 that is participating in the Event (the “Minor Participant”), the adult Participant agrees to accompany and ride with the Minor Participant during the entire Event. No Minor Participant shall participate in the Event if he or she is not accompanied by a parent or guardian.

This Release is unrestricted and not subject to any exceptions or limitations.
